The Trimble Firm, P.L.L.C., is handling pharmaceutical cases, including claims involving opioid use and addiction. Many states, counties, and other governmental agencies have filed claims against various opioid manufacturers, including Johnson & Johnson and Purdue Pharma. Until recently, individuals who have been addicted to opioid use through totally responsible circumstances, i.e. prescription from a treating physician, have been unable to pursue individuals claims for the damages they or a loved one has sustained. That has recently changed, and people injured by opioids that were manufactured, marketed and sold by Purdue Pharm, including OxyContin, MS Contin and Ryzolt, can file personal injury claims against this company. Purdue is in bankruptcy in the U. S. District Court for the Southern District of New York. Part of the bankruptcy process involves distribution of Purdue’s assets among creditors and claimants.
As part of its bankruptcy filing, Purdue has settled with several states and local governments for an amount that may exceed $10 billion. No final settlement plan is in place at this time. The federal judge handling the bankruptcy matter has set a deadline of June 30, 2020, for injured parties, including individuals, hospitals and governmental entities to file claims.
Once a final settlement is in place, the bankruptcy court will divide and distribute Purdue’s assets among those with injury claims and other stakeholders. You could be eligible to file a claim if you or a loved one was prescribed any of Purdue Pharma’s opioid painkillers and became addicted to the drug. You could also be eligible for a claim even if you or your loved one ultimately used heroin or other illegal opiates after becoming addicted.
If you are uncertain whether you were prescribed an opioid manufactured by Purdue Pharma, check with the pharmacies you have used and check your prescription history. If you have used and been damaged by Purdue’s product, you may consider filing a claim through the U. S. District Bankruptcy Court for the Southern District of New York.
